Controversial laws allowing police to modify or delete the data in the online accounts of criminals should be axed, according to lawyers, who argue the measures give authorities powers that are close to a kind of “judge, jury and executioner”.
The Law Council of Australia appealed for the warrant to sunset as part of wide-ranging changes put forward to the review of the government’s ‘identify and disrupt’ laws on Wednesday.
It has also pushed back against a proposal from the Australian Federal Police (AFP) to expand the scope of account takeover warrants from ‘named accounts’ to ‘named persons’ without revisiting the thresholds for the powers.
